Program Description

On June 28, 2012 , in what was one of the most highly debated and closely watched decisions in history, the U.S. Supreme Court issued a landmark ruling on Patient Protection and Affordable Care Act. In this two-part series, panelists will explore new legal and practical questions raised and the potential implications of the Court's decision for Georgia.

PPACA and the Supreme Court: Different Perspectives

The Supreme Court upheld the individual mandate to purchase health insurance as constitutional, not under the Commerce Clause, but under Congress's power to tax. Law faculty panelists will discuss the constitutional implications of the Supreme Court's decision, what the decision says about the Roberts Court, and the impact of the decision on the right to health care in the U.S.

The Impact of the Supreme Court's Decision on the Future of Medicaid
Thursday, September 13, 2012

In the PPACA decision, the Supreme Court ruled that Congress could not coerce states into expanding Medicaid under PPACA by witholding existing Medicaid funds. With uncertainty created by upcoming elections, invited panelists will set forth the issues regarding Georgia's current Medicaid system and discuss how the Medicaid landscape may change in the wake of the U.S. Supreme Court's decision making the expansion of Medicaid optional for states.
