Sept. 14, 2009:

Class meets Thursday 9/15/07 at 3:30pm at the 11th Circuit Court of Appeals courthouse. Please arrive a bit before 3:30pm, go to through security, and wait for me and your classmates. Caleb Davies will come down to take us to the mediation offices. In advance of that class, please go to the 11th Circuit Mediation website and read the "Confidential Mediation Statement," the "Circuit Mediation Process" (flowchart), and the "Mediation and Guidelines for Effective Mediation Representation" sections. Also, please read Mr. Davies' article, "Getting Value from Appellate Mediation: Working With the Mediator."

 

 

August 23, 2009:

We will not have class on Tuesday, August 25. Please continue to explore and refine your paper topics. I'm happy to meet with you if you need to discuss topics further.

 

 August 16, 2009:

In advance of our class on Tuesday, please take time to scan the literature, e.g., some of the titles of mediation-related recent law review articles (and other sources). Send me 2-3 titles (or topics that are interesting to you if you don't see any titles that match any predetermined interest you have) by e-mail. We will base our discussion on topics of current interest that you identify. Ultimately, your topic must be approved by me. Please submit your topic proposal for approval by Sept. 1. Do not hesitate to consult with me at any time. Your submission must include a draft title, a brief description of the topic (akin to a thesis statement), and a list of relevant and authoritative references that you will be using to research the topic.

 

Papers should range from 5-10 pages of text, double-spaced, 12-point Times New Roman font, with endnotes in bluebook format and followed by a bibliography of the most recent, authoritative, and relevant references on the topic. Endnotes do not count as text. I would like to see a first draft by September 15. A final draft will be due on October 6. Clarity and conciseness are valued. You can submit the proposal and draft materials to me electronically. The final draft should be submitted electronically and with 2 hard copies.

 

If it makes sense for your topic, please try to frame the topic so as to be relevant to Georgia mediators, advocates, or policymakers, e.g., "Misuses of Apology in Mediation," "Why I'll Never do a Divorce Mediation," "Does Religion Play a Role in Mediator Strategy?" An Interview with Georgia Mediator (name)," "Mediation in Ant Colonies in Georgia," "Mediating Blood Feuds: Practice Pointers for Georgia Mediators," or "Legal Considerations in Coca Cola's Class Action Mediations."

 

For those of you who can and would like to mediate in the Landlord/Tenant program on Thursdays, we can discuss an alternative paper based on your cases.
