1. You will have 20 minutes for the initial interview. Explain to Simon that you must leave for a court date in 20 minutes but that you have already scheduled time for a follow-up interview in a week.
2. Use the 20 minutes as you think best.
3. The only requirement is that at some point during the initial interview you must explain to Simon about the confidentiality of the interview. Assume that Model Rules 1.6 and 3.3 apply in your jurisdiction.
4. Simon is a high school graduate and understands as much about the Housing Authority rules governing eviction as you do, just from living in the "projects" for a number of years. Use language you can expect he or she will understand but do not "talk down" to Simon.
5. Remember this case takes place in New York City in January 1987 and feel free to refer to the December 1986 calendar.
If you are in Group A-2, do NOT come to class until 8:20 am (but please arrive promptly at 8:20). Group A-2 will not observe the first simulated interview by Group A-1. However, Group A-1 WILL observe the A-2 interview. (For the second interview, Group A-2 goes first gets to watch A-1 at 8:20). Students not assigned to the Simon Exercise can observe both interviews.
In class one student from each side will play the prepared role while the other three (or four) observe. I will announce at the beginning of class which student in each group will actually play the role. Following the interview, I will discuss the interview with that group and other students who are observing.
