EXERCISE ONE: SIMON CASE

This is an initial client interview. The lawyer (and the client) have the information contained in the Simon Case: General Background Memo. 

The lawyer will have 20 minutes for the initial interview and can use the 20 minutes as the lawyer  thinks best. . The only requirement is that at some point during the initial interview the lawyer must explain to Simon about the confidentiality of the interview. The lawyer is to assume that Model Rules 1.6 and 3.3 apply in the jurisdiction.

There will be two role plays of the interview: Group A1 at 7:40 am and Group A2 at 8:20 am. If you are in Group A-2, do NOT come to class until 8:20 am (but please arrive promptly at 8:20). Group A-2 will not observe the first simulated interview by Group A-1. However, Group A-1 WILL observe the A-2 interview. (For the second interview later this month Group A-2 goes first and gets to watch A-1 at the later interview). 

Students in the class not assigned to Group A can observe both interviews.

One student from each side will play the prepared role while the other three (or four) observe. I will announce at the beginning of class which student in each group will actually play the role. Following the interview, I will discuss the interview with that group and other students who are observing. We will make every effort to have the videotape posted on the course web site by 5pm Friday.
